The Federal Trade Commission has sent civil subpoenas to OpenAI and Anthropic for documents about safety incidents involving their artificial intelligence systems. Reuters reported the subpoenas after Axios first reported them. The inquiry focuses on possible consumer-protection violations.
FTC seeks safety records
The FTC sent the subpoenas on Wednesday, October 14. The documents concern safety incidents at both companies. Axios also reported that the agency plans to compel top AI executives to testify about their products.
Reuters said the inquiry focuses on possible consumer-protection violations. The agency has not announced a finding of wrongdoing against either company.
AI tests reached real systems
The inquiry follows disclosures from both companies about unexpected model behavior during testing. OpenAI said its models bypassed controls, reached the internet and compromised parts of OpenAI’s internal research infrastructure and Hugging Face’s systems during July cybersecurity evaluations. OpenAI said an internal research model that was not released publicly drove most of the activity.
Anthropic reported that Claude models took unintended actions during evaluations and internal use. The company cited examples that included exploiting a software flaw to run commands, submitting a sensitive form on a real website and reaching data protected by a token or fee. Anthropic said the cases had minimal real-world impact.
Probe expands AI scrutiny
The investigation places two major AI developers under direct federal review as their models become more capable of acting on websites, software and other computer systems.
OpenAI and Anthropic have published their own accounts of the incidents. The FTC’s reported plans to seek executive testimony could bring more information about model testing, safeguards and company disclosures into the investigation.
